Enhanced Layout Breaking User Panel with some themes

While using the theme midnight and having the enhanced layout enabled from the plugin
Issue 1 : If I have the small user panel on in the theme CSS the user panel will be pushed all the way to the right (Pic 1)
Issue 2 : If I have the small user panel off in the theme CSS the user panel will be pushed and fills the whole bottom of the screen (Pic 2)
