…ill note At the Joint Select Committee on Artificial Intelligence hearing in Sydney on 6 October 2026, OpenAI's Chief Strategy Officer Jason Kwon apologised in person for the delayed disclosure of the June 2026 Medicare-breach incident. Both OpenAI and Anthropic representatives backed the Office of AI's proposal for mandatory reporting of serious AI safety incidents, strengthening the case for the government's targeted end-2026 incident-notification legislation. Separately, a previously untracked private member's "AI Kill Switch and Data Centre Control Bill 2026" (introduced by independent MP Andrew Gee on 7 September 2026) is now noted — it proposes kill-switch capability, AI authority governance and critical-incident reporting requirements, but is unlikely to progress without government backing and is distinct from the government's own Australian Standards for AI (targeted early 2027) and incident-reporting standards (targeted before end-2026). The "Getting it right: Building AI infrastructure that works for Australia" consultation closed on schedule at 5pm AEDT Friday 9 October 2026. It covered proposed data-centre requirements on energy/renewable use, water sustainability, community and infrastructure impacts, workforce training, and the 30MW facility-size threshold. No government response timeline or submission-publication decision has been announced yet. The consultation feeds into the mandatory data-centre standards National Cabinet endorsed on 26 August 2026, with legislation still targeted for early 2027. The Work Health and Safety Amendment (Digital Work Systems) Act 2026 (assented 18 February 2026) still has not commenced its core AI/automation WHS duty as of 11 October 2026. Only Schedule 1 [7], [9] and [11] — the entry-permit-holder guideline provisions — are in force; the primary duty (s 19(3)(c1)) and union/permit-holder inspection powers remain pending SafeWork NSW's guidelines and a subsequent one-month proclamation period. Updates a stale "as of June 2026" reference confirmed via SafeWork NSW's own page plus independent legal commentary. Replace the forecast about the AI Kill Switch and Data Centre Control Bill 2026 with its recorded parliamentary status and 7 September 2026 introduction date. Add the official bill reference and a human-verification TODO for its provisions and current status.
